Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SiteNote AI mobile application and web platform (the "Service") operated by SiteNote AI ("we," "our," or "us"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years of age to use this Service. By creating an account, you represent that you meet this requirement and have the legal authority to enter into these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

3. Your Content

You retain ownership of all photos, annotations, inspection data, and reports ("Your Content") that you upload or create through the Service. By using the Service, you grant us a limited license to store, process, and transmit Your Content solely to provide the Service to you.

You are responsible for ensuring that Your Content does not violate any applicable laws or third-party rights. We do not review or moderate Your Content.

4. AI Features

The Service includes AI-powered features that analyze photos and generate issue drafts. AI outputs are suggestions only and are provided "as is." You are solely responsible for reviewing, editing, and approving all AI-generated content before including it in official reports or communications.

We do not guarantee the accuracy, completeness, or reliability of AI-generated content. AI analysis does not constitute professional inspection, engineering, or legal advice.

5. Subscriptions and Payments

Some features require a paid subscription ("Pro" plan). Subscriptions are billed monthly and auto-renew unless cancelled. Pricing is subject to change with 30 days notice.

• iOS: Subscriptions purchased through the App Store are governed by Apple's terms. Manage subscriptions in your Apple ID settings.
• Android: Subscriptions purchased through Google Play are governed by Google's terms. Manage subscriptions in Play Store settings.
• Web: Web subscriptions are processed by Stripe. You may cancel at any time from the Settings page.

Free trial periods, if offered, convert to a paid subscription at the end of the trial unless cancelled before the trial expires.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated means (bots, scrapers) to access the Service
• Interfere with or disrupt the Service or its infrastructure
• Upload malicious code, viruses, or harmful content
• Resell or redistribute the Service without written permission

7. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by SiteNote AI and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. AI-generated content may contain inaccuracies. The Service does not replace professional inspection, engineering, or safety assessments.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITENOTE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless SiteNote AI, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting support@sitenoteai.com. Upon termination, your right to use the Service ceases, and we may delete your data after 30 days.

12. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service constitutes acceptance of updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which SiteNote AI is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.
